Liability Waiver & Assumption of Risk

PLEASE READ CAREFULLY. This document affects your legal rights. It includes an assumption of risk and a release of certain claims. By accepting it you agree to let ShiftFuel Concierge take possession of and operate your vehicle to perform the service you request.
1. Authorization to Access and Move Your Vehicle
By accepting this waiver and submitting a service request, you authorize ShiftFuel Concierge and its assigned workers to access, enter, start, move, drive, park, fuel, wash, visually inspect, photograph, secure, and return your vehicle as reasonably needed to complete the service you selected, including reasonable travel to and from third-party fuel or wash facilities and any return trip required if service is cancelled after it begins.
2. Your Ownership and Authority
You represent that, to the best of your knowledge:
- you own the vehicle or have the owner's permission to request this service;
- you are authorized to allow ShiftFuel Concierge to possess and operate it;
- the vehicle is lawfully registered and the legally required insurance is in force;
- no lease, rental, financing, insurance, employment, or other agreement prohibits this service; and
- operating the vehicle does not require a license endorsement, accommodation, or specialized skill that you have not disclosed.
3. Assumption of Risk
You understand that having someone else access, drive, fuel, and wash your vehicle involves ordinary and reasonably foreseeable risks. You knowingly and voluntarily assume the ordinary risks arising from the ShiftFuel Concierge service, including those associated with:
- driving, moving, and parking the vehicle;
- parking lots, roads, traffic, and weather;
- gas stations, car washes, and other third-party facilities;
- vehicle alarms, immobilizers, and security systems;
- loose, aftermarket, or modified components, trim, antennas, or roof accessories;
- pre-existing scratches, dents, leaks, warning lights, wear, and mechanical defects;
- personal property left in the vehicle; and
- temporary delays, closures, and service interruptions.
These are risks inherent in the service itself and are not caused by ShiftFuel Concierge.
4. Vehicle Condition and Disclosure
You agree that the vehicle is safe to operate and that you have accurately disclosed any condition that could affect the service, including dashboard warning lights, low tire pressure, fluid leaks, battery or starting issues, transmission or clutch problems, modified or non-standard controls, ignition interlocks, unreliable locks or keys, defective mirrors, lights, brakes, steering, or wipers, and any unusual starting, shifting, fueling, or parking instructions.
ShiftFuel Concierge may decline to start, or may stop operating, any vehicle when a worker reasonably believes it is unsafe to drive or service.
5. Fuel Selection
For fueling services, you are responsible for selecting and confirming the correct fuel type and grade for your vehicle, including whether it takes gasoline or diesel and any manufacturer-required fuel specification. You are responsible for damage resulting from incorrect or incomplete fuel information that you supply. This does not apply where ShiftFuel Concierge uses a fuel inconsistent with the fuel type you correctly confirmed in the service request.
6. Personal Property
You are responsible for removing or securing personal property, valuables, cash, electronics, documents, weapons, medications, and other sensitive items before service. ShiftFuel Concierge does not inventory the contents of your vehicle and is not responsible for unsecured, hidden, loose, fragile, valuable, or sensitive items left inside, except where required by law.
ShiftFuel Concierge may decline or stop service if the vehicle contains an unsecured firearm or weapon, illegal drugs or contraband, hazardous materials, an animal, an unattended child or person, or anything else that makes operating the vehicle unsafe or unlawful. Electronic toll devices should be removed; otherwise ordinary toll charges may be incurred along the approved service route.
7. Third-Party Facilities
Some services require the use of a gas station, car wash, parking area, or other third-party location. ShiftFuel Concierge does not control the acts, equipment, inventory, pricing, hours, or facility conditions of those independent locations. This does not exclude responsibility for ShiftFuel Concierge's own conduct in selecting or using a facility where responsibility cannot lawfully be excluded.
If you select a specific gas station rather than the closest available one, ShiftFuel Concierge does not guarantee the fuel grade, fuel quality, pricing, hours, or availability at that station, and is not responsible for issues, delays, or added travel arising from your choice. If your selected station is closed, out of your requested fuel, or otherwise unusable on arrival, ShiftFuel Concierge may use the nearest suitable alternative to complete your service. If a substitute station would materially increase your price — for example, a higher distance surcharge, brand, or route — ShiftFuel Concierge handles that change as described in the Terms of Service: a material increase requires your approval unless a change is necessary to protect a person, vehicle, or property in an emergency.
Automatic car washes carry ordinary risks to loose trim, antennas, roof accessories, aftermarket parts, wraps or decals, and existing paint, clear-coat, or previously repaired areas. You are responsible for telling us if your vehicle has any accessory or condition that makes an automatic wash inappropriate.
8. Accidents, Breakdowns, and Emergencies
ShiftFuel Concierge does not provide towing or roadside assistance and is not itself a towing or roadside provider. If the vehicle breaks down, is disabled, or is involved in an incident during service, you authorize ShiftFuel Concierge to stop operating it, park it in a reasonably safe location, contact you, contact police or emergency services, arrange towing or roadside assistance when reasonably necessary, share the customer, vehicle, insurance, and location information needed with responders, and document the incident with photos and notes. Arranging towing or roadside assistance means engaging an independent provider on your behalf; that provider, not ShiftFuel Concierge, performs the tow or roadside work. Who pays follows the cause: costs from a pre-existing vehicle problem or the vehicle's condition are your responsibility, and costs from damage caused by ShiftFuel Concierge are ShiftFuel Concierge's responsibility.
9. No Mechanical Services
ShiftFuel Concierge does not provide mechanical inspection, diagnosis, repair, maintenance, towing, roadside assistance, or emergency vehicle services. Vehicle add-ons and visual documentation are not a substitute for service by a licensed mechanic, repair shop, roadside assistance provider, or emergency responder.
10. Photos and Documentation
ShiftFuel Concierge may take pickup, return, odometer, fuel gauge, receipt, and condition photos to document the service. These records may be used for customer tracking, service verification, support, payment review, safety review, insurance review, tax or legal review, operational review, or dispute handling, and may be retained long term.
11. Release of Certain Claims
In consideration for receiving the service you requested, and to the fullest extent permitted by law, you knowingly and voluntarily assume the ordinary and reasonably foreseeable risks described above and release the ShiftFuel Parties (defined below) from claims arising solely from:
- the risks you assumed under this waiver;
- pre-existing vehicle conditions and normal wear and tear;
- manufacturer defects;
- inaccurate or incomplete information you supply, including vehicle, fuel, access, and location details;
- inaccessible vehicles and parking violations caused by incorrect customer information; and
- acts, conditions, or facilities of independent third parties that are outside ShiftFuel Concierge's reasonable control.
This release does not apply to gross negligence, recklessness, intentional misconduct, fraud, or any liability that applicable law does not allow to be released.
12. The ShiftFuel Parties
In this waiver, "ShiftFuel Concierge," "we," "our," and "us" refer to the ShiftFuel Concierge vehicle concierge service, based in Wilmington, Delaware. The "ShiftFuel Parties" are ShiftFuel Concierge together with its owners, officers, employees, and authorized workers, and its agents, representatives, successors, and permitted assigns.
13. This Is Not Insurance
This waiver is not an insurance policy and does not promise that any particular claim will be covered. It is intended to work alongside applicable insurance, not to replace it. Nothing here prevents you from reporting an accident or submitting a legitimate insurance claim, and you agree to cooperate with a reasonable investigation of any incident.
14. Reporting a Claim
If you believe an issue occurred during service, contact ShiftFuel Concierge promptly with your request number, photos, and a description of the issue so it can be reviewed against service records. Reporting as soon as possible, preferably within 48 hours of service completion or vehicle return, helps us review available photos, receipts, worker notes, and timing records; delayed reporting may limit the ability to verify what occurred. To support a fair review you should preserve relevant photos and records, avoid altering or repairing the disputed area before inspection when reasonably possible, permit a reasonable inspection, provide receipts, estimates, police reports, or insurance information when relevant, and take reasonable steps to prevent further damage. Nothing here prevents you from arranging immediately necessary repairs to protect people or prevent further property damage.
15. No Waiver of Required Legal Rights
Nothing in this waiver is intended to waive rights that cannot legally be waived under applicable law.
16. How This Fits with Our Other Terms
This Liability Waiver governs assumption of risk and released claims. The Terms of Service govern payment, service operations, account use, and other general contractual matters. The Privacy Policy governs how we collect and handle personal information.
17. Acceptance
At checkout you accept this Liability Waiver by a separate acknowledgment, distinct from your acceptance of the Terms of Service and Privacy Policy. By checking that box you confirm that you have read, understood, and voluntarily agreed to this Liability Waiver and Assumption of Risk, including the authorization for ShiftFuel Concierge to possess and operate your vehicle. ShiftFuel Concierge records your acceptance with the applicable Service Request, including the customer account or verified contact information, Vehicle, waiver version, a fingerprint of the accepted waiver text, and the date and time of acceptance.
18. Governing Law
This Liability Waiver is governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
