Terms of Service

Who These Terms Are With
These Terms of Service (the “Terms”) are an agreement between you and the ShiftFuel Concierge vehicle concierge service, based in Wilmington, Delaware (“ShiftFuel,” “we,” “us,” or “our”). By booking or using ShiftFuel Concierge, you agree to these Terms, our Privacy Policy, and our Liability Waiver.
Definitions
In these Terms:
- “Customer,” “you,” or “your” means the person who books or uses a Service.
- “Vehicle” means the motor vehicle identified in a Service Request.
- “Worker” means the ShiftFuel personnel assigned to perform a Service.
- “Service Request” means a booking you submit through ShiftFuel Concierge.
- “Service” means the vehicle fueling, car-wash, and quick-care services — the last being the “Vehicle Add-Ons” you can attach to a fuel or wash booking, such as a tire-pressure top-off, washer-fluid refill, and quick exterior look-over — and related concierge services selected in a Service Request. ShiftFuel drives your Vehicle to a gas station to fuel it; it does not deliver fuel to your location.
- “Service Address” means the location where the Vehicle is picked up and returned.
Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to book a Service. By booking, you confirm that you meet these requirements.
Use of ShiftFuel Concierge
By booking or using ShiftFuel Concierge, you agree to provide accurate customer, Vehicle, Service Address, parking, key handoff, and payment information. You confirm that you are authorized to request service for the Vehicle and to provide access to the Vehicle and keys.
Authorization to Operate Your Vehicle
You authorize ShiftFuel and its assigned Worker to possess the keys, and to enter, start, move, operate, transport, fuel, wash, park, photograph, and return the Vehicle as reasonably necessary to complete the requested Service. This includes driving the Vehicle from the Service Address to and from the selected gas station or car wash and back to the Service Address (or another safe location agreed under “Breakdowns, Accidents, and Emergencies” below). This authorization applies from key or Vehicle handoff until the Vehicle and keys are returned or the Service Request is otherwise ended.
Your Representations About the Vehicle
Each time you book, you represent that, to the best of your knowledge:
- You are the owner of the Vehicle or have the owner’s permission to request the Service;
- The Vehicle is lawfully registered and displays valid plates;
- Required insurance is active and no restriction prohibits an authorized driver other than you from operating the Vehicle;
- The Vehicle is roadworthy and safe to operate;
- You have disclosed any known mechanical, electrical, tire, brake, steering, alarm, lock, fuel, or drivability problem that could affect safe operation; and
- The Vehicle does not contain illegal, hazardous, or dangerous materials.
If the Vehicle requires special insurance or licensing, has an ignition interlock, a manual transmission, a modified ignition or controls, or any other feature requiring specialized operation, you must disclose it before booking. ShiftFuel may decline a Service the assigned Worker cannot safely or lawfully perform.
You must also tell us before booking about any feature or condition that affects how the Vehicle is driven, parked, or washed, including: low ground clearance or unusual height or width; roof racks, spoilers, antennas, bike or cargo carriers, aftermarket accessories, wraps, decals, or delicate or previously repaired paint; whether the Vehicle is electric or hybrid; any keyless-entry, push-button, PIN-to-drive, valet-mode, or anti-theft procedure needed to start or move it; and automatic emergency braking or driver-assist features that may activate during low-speed maneuvering. If any manufacturer restriction makes an automatic car wash inappropriate for your Vehicle — for example, a requirement to disable wipers or sensors, retract the antenna, or avoid brush washes — you must tell us before booking a wash.
You are responsible for accurately identifying the Vehicle’s required fuel type — Regular, Mid-grade, or Premium gasoline, Diesel, or any manufacturer-required specification — when you book. ShiftFuel is not responsible for damage caused by incorrect or incomplete fuel information you supply. This does not limit responsibility for a fuel-selection error made by ShiftFuel contrary to the information you confirmed in the Service Request.
Vehicles and Conditions We Cannot Service
ShiftFuel may decline, pause, or stop a Service, coordinated with the Worker’s safety checklist, when the Vehicle is or appears to be: unsafe or not roadworthy; showing an active warning condition affecting safe operation; carrying a flat or dangerously damaged tire; leaking fuel or fluids; missing registration or displaying unlawful plates; oversized or a commercial vehicle; a vehicle requiring specialized licensing; equipped with an ignition interlock; or unusually high-value, heavily modified, specialized, or unfamiliar such that the assigned Worker cannot safely operate it or it falls outside ShiftFuel’s service or insurance requirements. ShiftFuel may also decline service if the Vehicle contains weapons, illegal drugs, hazardous materials, animals, or unattended children.
Customer Accounts and Sign-In
If you create or use a customer account, you are responsible for keeping your sign-in information secure and for promptly telling ShiftFuel Concierge if you believe your account, password, email, phone number, or device has been compromised. Face ID, Touch ID, Android biometric unlock, Windows Hello, and similar device unlock features are controlled by your device provider or password manager; ShiftFuel does not receive your biometric data.
Account recovery emails, password reset emails, username recovery emails, verification codes, and security notices may be sent to the email address associated with your account. ShiftFuel Concierge may revoke sessions when needed for security, support, or account recovery.
Service Availability
Service availability is confirmed during booking. ShiftFuel Concierge may deny, cancel, or reschedule a request when service cannot be safely or reasonably completed, including due to location, weather, vehicle access, payment issues, worker availability, inaccurate information, safety concerns, or service limitations. ShiftFuel may make reasonable operational changes that do not materially increase your price or change the Service you selected; any material change requires your approval unless a change is necessary to protect a person, Vehicle, or property during an emergency. If ShiftFuel cancels a request before keys are received, the authorization described below is released and the authorization to operate your Vehicle does not take effect.
Payment Authorization and Final Charges
Your payment method may be authorized when you book. That authorization is a temporary hold or saved-card authorization step, not the final charge. You are not charged until service is completed, unless a cancellation, return request, or service interruption after keys are received or service has started results in an applicable cancellation, return, or service fee.
Fuel and car wash prices shown during booking are estimates based on the services you select and the information available at the time of booking. Final totals may vary based on selected service fees, add-ons, actual fuel or car wash receipt totals, approved adjustments, or changes you request during the Service. Customer-facing prices already reflect ShiftFuel’s operating costs, including payment-processing expenses. ShiftFuel does not separately add a payment-processing surcharge unless it is clearly disclosed to you before payment and permitted by applicable law and payment-network rules. If the final captured amount is lower than the authorization, the unused portion is released according to your card issuer’s timing.
Promotions and Marketing Email
Promotional emails are optional. If you opt in to promotions and offers, ShiftFuel Concierge may email promotional codes, offers, or service updates that are promotional in nature. You may unsubscribe from promotional emails at any time. Unsubscribing from promotional email does not stop transactional, account-security, booking, payment, support, or service-related messages.
Promotional codes, discounts, and offers may have eligibility rules, expiration dates, service limitations, account or customer targeting, minimum order amounts, redemption limits, and other restrictions shown with the offer or enforced at checkout. ShiftFuel Concierge may modify, disable, or refuse promotional offers where misuse, error, fraud, ineligibility, or technical issues are detected.
Gas Station Selection and Distance Surcharge
For fuel services, ShiftFuel Concierge fuels your vehicle at the closest available gas station to your service address at no additional charge. You may instead select a different, farther gas station. If you do, a distance surcharge of $0.75 for each additional round-trip mile beyond the closest station applies, calculated from driving distances and added to your authorized total before you confirm booking. The surcharge is shown to you during booking, and the closest-station option always remains available with no surcharge.
Gas stations and car washes are independent third parties. ShiftFuel does not control and does not guarantee their hours, prices, equipment, inventory, fuel grade, fuel composition, fuel or wash quality, temporary closures, or facility rules. ShiftFuel uses reasonable care in selecting and using a facility; this does not make ShiftFuel a guarantor of a third-party facility’s products or service.
Cancellations and Return Requests
What you are charged if you cancel depends on how far the Service has progressed. The app calculates the amount automatically and shows it to you before it is captured. The amount shown in the app controls, except for an objectively documented adjustment. The stages are:
- Before keys are received — you may cancel from the app at no cancellation charge.
- After keys are received but before the Vehicle is moved — a flat cancellation fee of $15 applies, and the Worker returns your keys.
- After the Worker has taken the Vehicle but before the Service begins — the cancellation fee above plus the cost of the driving already performed apply, and the Worker returns the Vehicle.
- After the Service has begun or been completed — actual fuel and car wash receipt totals, the service fees for work performed (including a proportional charge for any add-on or partly completed service leg), and the cost of the driving performed apply, and the Worker returns the Vehicle.
- After the Vehicle has been returned or the Service is complete — the request can no longer be cancelled.
How cancellation amounts are determined. Any applicable cancellation or return amount is calculated automatically by the ShiftFuel application based on the stage of the Service Request, work already completed, applicable service fees, receipt totals, mileage, operational records, and other pricing information associated with the Service. The calculated amount is presented to you before it is captured. If you believe the amount is incorrect, contact ShiftFuel Concierge with your request number and we will review it using the available service records, receipts, photographs, GPS information when available, and other operational documentation.
ShiftFuel will not capture more than the amount authorized through the payment flow unless you approve an additional authorization or another legally permitted payment step is completed.
Once keys are received, direct cancellation from the app may not be available; instead you request Vehicle return, and the applicable amount above is captured when the keys or Vehicle are handed back. Because sensitive actions such as a cancellation or Vehicle-return request must be protected against misuse, ShiftFuel may require email, phone, account, or one-time-code verification before processing them.
Customer Responsibilities
You are responsible for providing safe and lawful parking, accurate key handoff instructions, clear Vehicle identification, and a Vehicle condition suitable for the requested Service. You must disclose any Vehicle condition that could affect safe service, including mechanical, electrical, tire, brake, steering, alarm, lock, fuel, or drivability concerns.
ShiftFuel does not inventory personal property left in the Vehicle. You should remove cash, medications, identification documents, firearms, electronics, valuables, and other sensitive property before service. ShiftFuel is not responsible for undisclosed or unsecured personal property except to the extent a loss is directly caused by conduct for which liability cannot lawfully be excluded. If a Worker discovers an unsecured firearm in the Vehicle, the Worker may decline to take custody of the Vehicle until it is removed or safely secured.
Tolls, Parking, Citations, and Towing
You are responsible for tolls incurred on the approved route, parking charges reasonably needed to complete the Service, preexisting parking tickets, and citations or towing caused by the Vehicle’s condition — such as defective registration, inspection, or equipment — or by your instructions. ShiftFuel is responsible for a moving violation committed by its Worker and for towing caused by the Worker’s error. A citation or towing charge is allocated to whichever party’s conduct or the Vehicle’s preexisting condition caused it. When ShiftFuel arranges towing or roadside assistance, it engages an independent provider on your behalf and is not itself the towing or roadside provider.
Breakdowns, Accidents, and Emergencies
If the Vehicle will not start, breaks down, becomes unsafe, has a flat tire, is involved in an accident, is stopped by police, or cannot be returned to the original location, ShiftFuel may stop the Service, contact you, contact emergency services, arrange towing when reasonably necessary, return the Vehicle to another safe location with your approval when practicable, and preserve photographs and service records. If you cannot be reached and immediate action is reasonably necessary to protect people or property, ShiftFuel may place the Vehicle at a reasonably safe nearby location or with a towing provider and notify you as soon as practicable. Where the cause is a preexisting Vehicle problem, the resulting costs are your responsibility; where the cause is damage caused by ShiftFuel, those costs are ShiftFuel’s responsibility.
If an accident or incident occurs, you agree to cooperate reasonably with the review and any claim — including providing insurance information, sharing or allowing incident photographs, allowing a reasonable inspection of the Vehicle, communicating with the relevant insurers, and preserving relevant records. Nothing here requires you to admit fault or to waive any right under your own insurance.
Photos and Documentation
You agree that ShiftFuel Concierge may take pickup, return, odometer, fuel gauge, receipt, and condition photos to document the service. These records may be used for customer tracking, service verification, support, payment review, safety review, or dispute handling.
Service photos, receipt images, request history, and related records may be retained long term for verification, billing, dispute handling, tax, insurance, legal, and operational purposes. A request disappearing from the Track My Vehicle page after a display window does not mean the records were deleted.
Live Location Tracking
Location tracking of the assigned Worker’s device begins when the Worker starts traveling to your Vehicle — so you can see how far away your specialist is — and continues through key or Vehicle pickup, the Service, and any return trip, ending when the Vehicle and keys have been returned and the request is completed or closed (including a return trip after a cancellation). On the Track My Vehicle page, the Worker’s live location becomes visible to you once the Worker has your key or Vehicle. During the tracking period, ShiftFuel collects the assigned Worker’s real-time device location to power live tracking and your estimated arrival, guide the Worker’s route, and measure driving distance for any mileage-based charges, as described in the Privacy Policy. This reflects the assigned Worker’s device carrying out your Service; it is not a continuous track of you personally. By booking a Service, you consent to this location collection for the period described above.
Service Disclaimer and Limitation of Liability
ShiftFuel Concierge provides its services with reasonable care but does not warrant that the service will be uninterrupted, error-free, or available at all times, and disclaims implied warranties to the fullest extent permitted by law. Estimated times, prices, driving distances, and gas station or car wash availability are provided for convenience and are not guaranteed.
To the fullest extent permitted by law, ShiftFuel Concierge is not liable for indirect, incidental, special, or consequential damages, or for lost profits, arising out of your use of the service. Nothing in these terms limits any liability that cannot be limited under applicable law. This section does not waive your right to report and pursue a claim for physical damage to your vehicle caused during a service; those claims are handled through the reporting and claims process described in these Terms and the Liability Waiver.
Damage or Service Issue Reporting
If you believe damage, a missing item, an incorrect charge, or another service issue occurred, contact ShiftFuel Concierge promptly through the support channel provided with your booking, or at the contact address below, with your request number, photographs, and a description of the issue. Reporting as soon as possible, preferably within 48 hours of service completion or Vehicle return, helps us compare your report with service records and available photos.
To help us investigate, please preserve the Vehicle’s condition when practical, allow a reasonable opportunity for inspection, and avoid authorizing repairs before ShiftFuel has had a reasonable opportunity to inspect, except in an emergency. This reporting procedure helps us resolve issues efficiently and does not eliminate any right that cannot legally be waived.
Confirming that your insurance is active does not mean your personal policy will cover a Service or a ShiftFuel Worker; coverage and exclusions vary by policy. How a claim is handled depends on ShiftFuel’s applicable insurance and the circumstances of the claim, not on an assumption that any particular policy applies.
Refusal or Incomplete Service
ShiftFuel Concierge may refuse, pause, return, or mark a service incomplete if the vehicle cannot be safely accessed, moved, fueled, washed, serviced, or returned. Reasons may include unsafe conditions, inaccurate instructions, locked or inaccessible vehicles, missing keys, payment issues, weather, third-party facility issues, or worker safety concerns.
Acceptance of Terms
Before you authorize payment for a booking, ShiftFuel Concierge asks you to affirmatively check two separate boxes: one confirming that you have read and agree to these Terms of Service and the Privacy Policy and that you authorize ShiftFuel to access, move, park, fuel, wash, photograph, and return your Vehicle for the Service; and a separate box confirming that you have read and voluntarily agree to the Liability Waiver & Assumption of Risk. Your acceptance of each is recorded separately with your Service Request, including the date and time and the version of the documents you accepted. Submitting a booking without both confirmations is not permitted.
Updates to These Terms
ShiftFuel Concierge may update these Terms as the Service changes; the “Last updated” date above shows the current version. For non-material changes, your continued use of the Service after an update means you accept the updated Terms. For a material change to payment, cancellation, dispute-resolution, liability, or tracking terms, ShiftFuel will ask you to affirmatively accept the updated Terms before your next booking.
Intellectual Property
The ShiftFuel Concierge name, logo, website, software, text, photographs, design, and other content are owned by ShiftFuel or its licensors and are protected by law. You may not copy, use, or reproduce them except as needed to use the Service normally.
Acceptable Use
You agree not to: submit fraudulent Service Requests or false Vehicle or payment information; access the Service or another person’s account without authorization; scrape, reverse engineer, or interfere with the Service; impersonate another person; harass a Worker; or use the Service for any illegal activity.
Third-Party Services
ShiftFuel relies on third-party providers, including payment processing (Stripe), mapping and routing tools, email delivery, and the independent gas stations and car washes used to perform the Service. Your use of the Service may be subject to those providers’ terms, and ShiftFuel is not responsible for the acts or omissions of independent third parties except as stated in these Terms. Links to external sites are provided for convenience and are not endorsements.
Electronic Communications
You consent to receive electronic records and communications related to your transactions, including booking, payment, security, and service messages. You may retain or print these records for your files.
Indemnification
To the extent permitted by law, you agree to indemnify ShiftFuel against losses caused by your lack of authority over the Vehicle, your false or incomplete information, an unsafe or unlawful Vehicle condition, illegal property in the Vehicle, your breach of these Terms, or your instructions that violate law or a third party’s rights. This does not require you to indemnify ShiftFuel for ShiftFuel’s own negligence or misconduct.
General
Assignment. ShiftFuel may assign these Terms in connection with a merger, sale, or transfer of its business. You may not assign your rights or obligations without ShiftFuel’s consent.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.
No waiver. ShiftFuel’s failure to enforce a provision on one occasion does not waive its right to enforce it later.
Entire agreement and order of precedence. These Terms, your booking confirmation, ShiftFuel’s posted pricing, the Privacy Policy, and the Liability Waiver together form the agreement between you and ShiftFuel. If the Liability Waiver conflicts with these Terms regarding assumption of risk or released claims, the Liability Waiver controls. If your booking confirmation conflicts with general pricing language, the booking confirmation controls.
Force majeure. ShiftFuel is not responsible for delay or failure to perform caused by circumstances beyond its reasonable control, including severe weather, road closures, emergencies, power or provider outages, governmental actions, and fuel shortages.
Survival. Provisions on payment, damage claims, limitation of liability, indemnification, privacy-related records, and dispute resolution survive completion or termination of a Service.
Governing Law and Disputes
These Terms of Service are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. The state and federal courts located in Delaware have jurisdiction over any dispute arising from these Terms or your use of the Service.
